Welcome to Kreate, India's largest dedicated marketplace for handmade and homemade products. These Terms and Conditions ("Terms") govern your use of our website, mobile application, and services (collectively, the "Platform").

The Platform is owned and operated by Crowdpouch Marketing Service Pvt Ltd, a company incorporated under the laws of India, with its registered office in Bangalore, India.

By accessing or using Kreate, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Platform.

• "Platform" refers to the Kreate website, mobile apps, and related services.
• "User" refers to any individual or entity accessing the Platform.
• "Buyer" refers to a User who purchases products on the Platform.
• "Seller" or "Vendor" refers to a User who lists and sells products on the Platform.
• "Products" refers to the handmade, homemade, or artisanal items listed for sale.

Eligibility: You must be at least 18 years old to use our Platform. By using Kreate, you represent and warrant that you have the right, authority, and capacity to enter into this agreement.

Account Registration: To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Prohibited Activities: You agree not to engage in any activity that interferes with or disrupts the Platform, including but not limited to:

• Using the Platform for any illegal purpose.
• Attempting to gain unauthorized access to other user accounts.
• Posting false, misleading, or defamatory content.
• Distributing viruses or harmful computer code.

Ordering Process: When you place an order, you are making an offer to purchase the Products. Orders are subject to acceptance by the Seller and availability of stock.

Payment: We use secure third-party payment gateways (e.g., Razorpay) to process payments. You agree to provide valid payment information. Prices listed include applicable taxes unless stated otherwise.

Shipping & Delivery: Shipping timelines are estimates provided by the Seller or our logistics partners. Kreate is not liable for delays caused by external factors.

Returns & Refunds: Returns are governed by the individual Seller's policy, which is displayed on the product page. If a product is damaged or incorrect, you must report it within 48 hours of delivery to be eligible for a refund or replacement.

Cancellations: You may cancel an order before it has been shipped by the Seller. Once shipped, the order cannot be cancelled.

Registration & KYC: Sellers must complete the KYC (Know Your Customer) process, including submitting valid ID proof, bank details, and business address. Approval is at the sole discretion of Kreate.

Subscription Plans: Sellers may choose from the following subscription tiers:

• Basic Plan: ₹50/month or ₹500/year.
• Pro Plan: ₹100/month or ₹1000/year.

Commissions: Kreate charges a commission fee on every successful sale. The commission rate varies by category and is deducted from the final payout.

Service Level Agreements (SLAs):

• Orders must be accepted within 24 hours.
• Orders must be shipped within 48 hours of acceptance.

Compliance:

• FSSAI: Sellers listing food items must provide a valid FSSAI license.
• GST: While optional for small businesses under a certain turnover, GST registration is encouraged for better tax compliance.

Payouts: Payouts are processed to the Seller's registered bank account after the return period for the order has expired, typically within 7-14 days of delivery.

Suspension: Kreate reserves the right to suspend or terminate Seller accounts for violation of these Terms, selling counterfeit goods, or consistently poor performance (e.g., high cancellation rates).

Content Ownership: Sellers retain ownership of the content (images, descriptions) they upload but grant Kreate a non-exclusive, worldwide, royalty-free license to use, display, and distribute this content for marketing and platform operation purposes.

Platform IP: All rights, title, and interest in the Platform, including software, design, and Kreate trademarks, belong exclusively to Crowdpouch Marketing Service Pvt Ltd.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and share your information.

We collect data necessary for order fulfillment, KYC verification, and improving our services. We do not sell your personal data to third parties.

Kreate acts as an intermediary marketplace. We are not a party to the transactions between Buyers and Sellers. We disclaim all liability for:

• The quality, safety, or legality of items advertised.
• The truth or accuracy of listings.
• Any loss of money, goodwill, or reputation arising from your use of the Platform.

In no event shall Crowdpouch Marketing Service Pvt Ltd be liable for any indirect, incidental, special, consequential, or punitive damages.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka.
